Welcome to Show Up Daily. These Terms of Service ("Terms") govern your use of our habit tracking application and services. By using Show Up Daily, you agree to these Terms.

Acceptance of Terms
By accessing or using Show Up Daily, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not use our service.
Your continued use of the service after changes to these Terms constitutes acceptance of the updated Terms.
Age Requirements and COPPA Compliance
Minimum Age Requirement
Show Up Daily is intended for users who are at least 13 years of age. By using our service, you represent and warrant that you are at least 13 years old.
Users Ages 13-17
If you are between 13 and 17 years old (a "Minor"), you may only use Show Up Daily with the consent and supervision of a parent or legal guardian. By using our service as a Minor, you represent that your parent or guardian has reviewed and agreed to these Terms.
Parental Consent
Parents and guardians are responsible for their children's use of Show Up Daily. If you are a parent or guardian and learn that your child under 13 has used our service, please contact us immediately at legal@showupdaily.app.
COPPA Compliance
We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If we discover we have collected such information, we will delete it promptly.
Description of Service
Show Up Daily is a minimalist habit tracking application that helps users build consistency in their daily practices. Our service includes:
- Timer functionality for tracking practice sessions
- Streak counting and progress visualization
- Achievement system and progress tracking
- Data synchronization across devices (for registered users)
- Local storage options for users without accounts
- Export functionality for user data
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice to users.
User Accounts
Account Creation
You may use Show Up Daily without creating an account. If you choose to create an account, you must provide accurate, current, and complete information and maintain the security of your account credentials.
Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account information
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Using a secure password and enabling available security features
Account Verification
We may require email verification for account creation and certain features. Failure to verify your email within 30 days may result in account restrictions.
Acceptable Use
You agree to use Show Up Daily only for lawful purposes. You may not:
- Use the service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service, servers, or networks
- Upload malicious code or attempt to compromise security
- Use automated tools to access the service without explicit permission
- Violate any applicable laws or regulations
- Impersonate another person or entity
- Collect or harvest information about other users
- Use the service to transmit spam, solicitations, or promotional materials
Violation of these terms may result in immediate termination of your account and legal action where appropriate.
Data Retention and Account Deletion
Data Retention Policy
We retain your data according to the following schedule:
- Active Accounts: Data retained while account is active
- Inactive Accounts: Data retained for 3 years after last login
- Deleted Accounts: Most data deleted within 30 days
- Legal Compliance: Some data may be retained longer as required by law
- Backup Systems: Data in backups deleted within 90 days
Account Deletion
You may request account deletion at any time by contacting legal@showupdaily.app. We will process deletion requests within 30 days. Note that:
- Some information may be retained for legal compliance purposes
- Anonymized data may be retained for analytics and service improvement
- Cached data may persist in our systems for up to 90 days
Data Export
Before deleting your account, you may request a copy of your data in machine-readable format (JSON/CSV). Export requests are processed within 7 business days.
Intellectual Property
Our Rights
Show Up Daily and all related trademarks, logos, designs, and content are owned by us or our licensors. You may not use our intellectual property without explicit written permission.
Your Data
You retain ownership of any data you input into Show Up Daily. By using our service, you grant us a limited, non-exclusive license to store, process, and display your data as necessary to provide the service.
User-Generated Content
Any feedback, suggestions, or ideas you provide about Show Up Daily may be used by us without compensation or attribution. This does not include your personal habit tracking data.
Service Modifications and Discontinuation
Service Changes
We reserve the right to modify, update, or discontinue any aspect of Show Up Daily at any time. We will provide reasonable notice for significant changes:
- Minor Updates: No advance notice required
- Feature Changes: 7 days advance notice via email or app notification
- Major Changes: 30 days advance notice
- Service Discontinuation: 90 days advance notice
Maintenance and Downtime
We may temporarily suspend the service for maintenance, updates, or technical issues. We will provide advance notice when possible, but emergency maintenance may occur without notice.
Service Discontinuation
If we decide to discontinue Show Up Daily, we will provide 90 days notice and offer data export options. We are not obligated to provide refunds for any unused service period.
Refund and Cancellation Policy
Free Service
Show Up Daily is currently provided as a free service. No payments are required, and therefore no refunds are applicable for the core service.
Future Paid Features
If we introduce paid features or subscriptions in the future:
- Users will be notified 30 days in advance
- Refund policies will be clearly communicated
- Existing users may have grandfathered access to current features
- Cancellation options will be provided in account settings
Donations and Tips
Any voluntary donations or tips are non-refundable unless required by applicable law. Donations do not create any obligation on our part to provide additional services.
Service Availability
We strive to maintain high availability of our service, but we cannot guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or other operational reasons.
We aim for 99.5% uptime but are not liable for service interruptions. Status updates will be provided during planned maintenance or unexpected outages.
Disclaimers
Show Up Daily is provided "as is" and "as available" without warranties of any kind.
We disclaim all warranties, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the service will be error-free or uninterrupted
- Warranties regarding the accuracy or reliability of content
- Warranties that the service will meet your specific requirements
Health and Wellness Disclaimer
Show Up Daily is a habit tracking tool and does not provide medical, health, or wellness advice. Consult healthcare professionals for medical concerns. We are not responsible for any health outcomes related to habits tracked in our app.
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Show Up Daily, including but not limited to:
- Data loss or corruption
- Loss of profits or business opportunities
- Service interruptions or unavailability
- Security breaches or unauthorized access
- Third-party actions or content
Our total liability for all claims related to the service shall not exceed $100 or the amount you paid us in the 12 months preceding the claim, whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some limitations may not apply.
Dispute Resolution and Arbitration
Informal Resolution
Before initiating formal dispute resolution, we encourage contacting us at legal@showupdaily.app to resolve the matter informally. We commit to responding within 10 business days.
Mediation
If informal resolution is unsuccessful, disputes may be resolved through mediation before a neutral mediator. Mediation costs will be shared equally unless otherwise agreed.
Binding Arbitration
Any disputes not resolved through mediation shall be settled through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
- Arbitration will be conducted in San Francisco, California
- The arbitrator's decision will be final and binding
- Class action lawsuits are not permitted
- Small claims court actions are excluded from this arbitration requirement
Exceptions to Arbitration
The following disputes are exempt from mandatory arbitration:
- Intellectual property disputes
- Claims for injunctive relief
- Small claims court actions under $10,000
- Disputes related to data breach or privacy violations
Termination
Termination by You
You may stop using Show Up Daily at any time. If you have an account, you may delete it by contacting legal@showupdaily.app or using account deletion features when available.
Termination by Us
We may terminate or suspend your access to Show Up Daily at our discretion, particularly if you violate these Terms. We will provide notice when possible, except for:
- Immediate security threats
- Fraudulent or illegal activity
- Repeated violations of these Terms
- Court orders or legal requirements
Effect of Termination
Upon termination, your right to use the service ceases immediately. We may delete your account and data according to our retention policy. Sections of these Terms that by their nature should survive termination will remain in effect.
Data Backup and Loss
While we implement robust backup procedures and redundancy systems, you are responsible for maintaining your own backups of important data. We are not liable for data loss, corruption, or deletion, except where caused by our gross negligence.
We recommend regularly exporting your data and keeping local copies of important information. Data export features are available in your account settings.
Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes by:
- Posting the updated Terms on this page with a new "Last updated" date
- Sending email notifications for material changes (if you have an account)
- Displaying prominent notices in the app for significant changes
- Providing 30 days notice for substantial modifications
Your continued use of the service after changes constitutes acceptance of the new Terms. If you disagree with changes, you should stop using the service and delete your account.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California (zip code 94107). You consent to the personal jurisdiction of such courts.
If you are located outside the United States, you acknowledge that these Terms are subject to U.S. law and jurisdiction, regardless of your local laws.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Show Up Daily regarding the use of our service. They supersede all prior communications, agreements, and understandings.
